| Abstract: | The objective of the protection action is the protection of fundamental rights, which is why in recent years it has become the most used mechanism in Colombia for the protection of people, against events or threats that violate their rights, always If the condition is met that there is no other protection mechanism that is suitable to achieve that purpose, then it could be determined that, although it is a preferential and summary mechanism, it also has a subsidiary and residual tint. The guardianship action, having these characteristics, is the means by which anyone can access justice. But guardianship is not a perfect mechanism, and that is when the guardianship ruling is not complied with, which causes the violation of rights to continue, the incident of contempt, is used as the mechanism where it is coercively demanded that the public authorities and individuals comply with the orders given to them. The contempt incident has a special procedure under the discretionary direction of the guardianship judge, who will carry out an adequate procedure observing the procedural guarantees of the subjects, ensuring at all times, the right to due process and defense. In addition, but its effectiveness is sometimes limited to the sanctions imposed by the guardianship judge. |
| Description: | El objetivo de la acción de tutela es la protección de los derechos fundamentales es por esto, que en los últimos años se ha convertido en el mecanismo más utilizado en Colombia para la protección las personas, frente a eventos o amenazas que vulneren sus derechos, siempre que se cumpla la condición de que no exista otro mecanismo de protección que sea idóneo para lograr ese propósito entonces se podría determinar que, aunque sea un mecanismo preferente y de carácter sumario también tiene un tinte subsidiario y residual. La acción de tutela al tener estas características es el medio por el cual cualquier persona puede acceder a la justicia. Pero la tutela no es un mecanismo perfecto, por ello cuando no se cumple el fallo de tutela, ocasiona que la vulneración de derechos continúe; el incidente de desacato, es utilizado como el mecanismo donde se exige de manera coercitiva que las autoridades públicas y a los particulares cumplan las órdenes que se les imparten. El incidente de desacato tiene un trámite de carácter especial bajo la dirección discrecional del juez de tutela, quien pondrá de un trámite adecuado observando las garantías procesales de los sujetos, asegurando en todo tiempo, el derecho al debido proceso y a la defensa, pero su efectividad en ocasiones se limita a las sanciones que impone el juez de tutela. |
