| Abstract: | The exploitation of natural resources and deforestation in Colombia have caused great environmental consequences, affecting fundamental ecosystems and putting the country's sustainability at risk. Although the Colombian Penal Code typifies these behaviors as crimes, the effectiveness of the sanctions imposed remains a controversial issue. Beyond the sanction, there is a need to investigate approaches that allow not only to punish those who commit these conducts, but also to repair the damage caused and prevent future damage to the environment. This research not only analyzes the jurisprudence issued by the Supreme Court of Justice for these crimes, but also explores whether there are models of restorative justice that can help to complement the country's criminal sanctioning system. Through a qualitative approach, the study examines rulings of the Supreme Court of Justice, identifying patterns in the application of the law and the type of sanctions applied. To this end, an analysis sheet of different sentences is developed to systematize key information, such as the type of punishable conduct, aggravating factors and, finally, the decisions. Beyond analyzing the decision in each sentence taken, this research seeks to propose other types of restorative justice alternatives that include the repair of environmental damage, the rehabilitation of offenders and the intervention of the community in the restoration of affected ecosystems. Restorative justice offers a broader view, which not only holds those who have committed an environmental crime accountable, but also seeks ways to repair the damage caused to the ecosystem. With this analysis, tools are provided to strengthen the regulatory framework and promote a more comprehensive approach in the conflagration against environmental crimes in Colombia.The research also invites to reflect on the role of justice in the protection of nature and the construction of a more effective and sustainable model to face these challenges. |
| Description: | El aprovechamiento de los recursos naturales y la deforestación en Colombia han traído consigo grandes consecuencias ambientales. Estas afectaciones no solo han deteriorado ecosistemas vitales, sino que también han puesto en riesgo la sostenibilidad ambiental del país. Si bien el Código Penal contempla estas conductas como delitos, aún persisten dudas sobre si realmente existe una efectividad de las sanciones que se imponen. Desde esta perspectiva, se advierte la necesidad de ir mas allá de la sanción, es fundamental explorar alternativas que permitan implementar acciones orientadas a la restauración ambiental y, sobre todo, prevenir que estos hechos se repitan. Esta investigación parte del análisis de la jurisprudencia de la Corte Suprema de Justicia frente a estos delitos, pero también se propone ir un paso más allá; indagar sobre otros modelos de justicia restaurativa. A través de una metodología cualitativa, se analizan distintas sentencias emitidas por la Corte, buscando patrones en la aplicación de la ley, la valoración de los hechos y las sanciones impuestas. Para lograrlo, se construye una ficha de análisis que permite organizar y sistematizar información clave como el tipo de conducta punible, los agravantes y las decisiones adoptadas en cada caso. Mas allá de analizar las decisiones en cada fallo, esta investigación tiene como objetivo proponer otros modelos de justicia restaurativa que incluyan la reparación del daño ambiental, la rehabilitación de los que cometen los delitos y la participación de la comunidad en la restauración de los ecosistemas afectados. La justicia restaurativa proporciona una perspectiva mas amplia, que no solo responsabiliza a quienes han cometido el delito, sino que también busca formas de reparar el daño que se ha generado al ecosistema. Con este análisis, se aportan herramientas que permitan fortalecer el marco normativo y promuevan un enfoque mas integral para combatir los delitos ambientales en Colombia. La investigación también invita a reflexionar sobre el rol de la justicia en la protección de los ecosistemas y la construcción de un modelo mas eficaz y sostenible que permitan enfrentar estos desafíos. |
